1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of Borrova’s website, applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

“Borrova,” “we,” “us,” and “our” refer to Borrova. “You” and “your” refer to the person or organization using the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. You agree to provide accurate account information and keep it current. You are responsible for protecting your account credentials and for activity you authorize through your account. Notify us promptly if you become aware of unauthorized access.

You may access only the accounts, information, and materials you are authorized to use. Organizations are responsible for managing their authorized users and ensuring that those users comply with these Terms.

3. Use of the Services

Subject to these Terms, Borrova grants you a limited, non-exclusive, non-transferable right to access and use the Services for their intended purposes. You are responsible for your use of the Services and for compliance with applicable laws and regulations.

Borrova provides technology services and does not originate loans or provide lending, financial, or legal advice. Customers remain responsible for their own lending decisions, licensing, disclosures, and regulatory obligations. Use of the Services does not by itself establish compliance with any law or industry standard.

4. Acceptable use

You may not use the Services to:

  • Violate applicable law or infringe another person’s rights.
  • Submit fraudulent information or content you are not authorized to provide.
  • Send spam, distribute malicious software, or facilitate unlawful communications.
  • Access another person’s account or data without authorization.
  • Bypass access controls or interfere with the security or operation of the Services.
  • Copy, resell, or exploit the Services except as expressly authorized by us or by law.

5. Customer content

You retain your rights in information, documents, and other materials you submit to the Services (“Customer Content”). You grant Borrova permission to host, store, process, transmit, and display Customer Content as reasonably necessary to provide and maintain the Services and fulfill our obligations to you.

You represent that you have the rights, permissions, and lawful basis needed to provide Customer Content and authorize its use in connection with the Services. You are responsible for its accuracy and legality, for obtaining required consents, and for reviewing any results or communications before relying on or distributing them.

6. Intellectual property

Except for Customer Content and third-party materials, the Services and their software, design, branding, and other content are owned by Borrova or its licensors and are protected by intellectual-property laws. These Terms do not transfer any ownership rights to you. Rights not expressly granted are reserved.

7. Fees and payment

If you purchase a paid service, the fees, billing terms, and cancellation conditions disclosed at purchase or set out in your separate agreement apply. You agree to pay charges you authorize and applicable taxes.

8. Third-party services

The Services may include links to or integrations with third-party services. Your use of those services may be subject to additional terms and privacy policies. Borrova does not control third-party services and is not responsible for their availability, content, or practices.

9. Privacy

Our Privacy Policy describes how we collect, use, disclose, and protect personal information. Information about California privacy rights under the California Consumer Privacy Act, as amended, is available in the California privacy notice. Nothing in these Terms limits privacy rights that cannot be waived under applicable law.

10. Electronic communications

We may provide service-related notices and communications electronically, including through the Services or by email. You are responsible for maintaining current contact information and keeping copies of records you need to retain. Where separate consent to electronic records or signatures is required, that consent is requested in the relevant transaction.

11. Suspension and termination

You may stop using the Services at any time and contact us to request account closure, subject to any applicable subscription or contractual obligations. We may suspend or terminate access where reasonably necessary to address a violation of these Terms, security risks, misuse, or legal requirements.

Account closure does not automatically delete information subject to legal or customer retention requirements. Our Privacy Policy explains retention and deletion. Provisions that by their nature should survive termination will continue to apply, including ownership, accrued payment obligations, disclaimers, and limitations of liability.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or suitable for every intended use, or that any particular result will be achieved.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

13. Limitation of liability

To the extent permitted by applicable law, Borrova will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, arising from or relating to your use of the Services. This limitation does not exclude or limit liability that cannot lawfully be excluded or limited, or rights and remedies available under mandatory law.

14. Changes and general provisions

We may modify the Services and update these Terms from time to time. Revised Terms will be posted on this page with an updated date. We will provide additional notice of material changes where required by law. If you do not agree to revised Terms, you should stop using the Services.

If a provision is held unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later. If a separate written agreement with Borrova expressly conflicts with these Terms, that agreement controls for the Services covered by it.
